Article 3 – Applicability
• These terms and conditions apply to every offer from LiveYourSports and to every distance contract concluded between LiveYourSports and a consumer for shipments within the Netherlands.
• Before the distance contract is concluded, the text of these terms and conditions is made available to the consumer.
Article 4 – The offer
• If an offer is valid for a limited period, this is stated explicitly in the offer.
• All products include a complete and accurate description, detailed enough for the consumer to properly assess the product. All photos are a true representation of the products offered. Obvious mistakes or errors are not binding on LiveYourSports.
• Each product includes the necessary information so that the consumer knows what rights and obligations come with accepting the product.
Article 5 – The agreement
• The agreement is concluded at the moment the consumer accepts the offer and meets the conditions attached to it.
• If the consumer has accepted the offer electronically, LiveYourSports confirms receipt of the order electronically. As long as LiveYourSports has not confirmed receipt of the order, the consumer may cancel the agreement.
• If the agreement is concluded electronically, LiveYourSports takes appropriate technical and organisational measures to secure the electronic transfer of data and ensures a secure website. For electronic payments, LiveYourSports takes appropriate security measures.
• Within the limits of the law, LiveYourSports may check whether the consumer can meet their payment obligations, as well as all facts and factors relevant to responsibly entering into the distance contract. If, based on this check, LiveYourSports has good reason not to enter into the agreement, it may refuse an order or request or attach special conditions to it.
• No later than on delivery of the product, LiveYourSports will send the consumer the following information in writing: a packing slip with all order details.
Article 6 – Right of withdrawal
• The consumer may cancel an agreement for the purchase of a product within a cooling-off period of 28 days without giving reasons. LiveYourSports may ask for the reason for the return, but cannot require it. This does not apply to HOPE products ordered by the customer themselves without first checking with LiveYourSports that the products are correct.
• The 28-day cooling-off period starts on the day the consumer received the product, or: a. if the consumer ordered multiple products in one order: the day on which the consumer received the last product. b. for agreements for the regular delivery of products over a set period: the day on which the consumer received the first product.
Article 7 – Obligations of the consumer during the cooling-off period
• During the cooling-off period, the consumer will handle the product and its packaging with care. The consumer will only unpack or use the product to the extent needed to establish its nature, characteristics and operation. The principle is that the consumer may only handle and inspect the product as they would be allowed to in a shop.
• The consumer is only liable for any reduction in value of the product resulting from handling it beyond what is permitted.
Article 8 – Exercise of the right of withdrawal by the consumer and associated costs
• If the consumer exercises their right of withdrawal, they notify LiveYourSports within the cooling-off period using the returns form or in another clear way.
• The consumer returns the product as soon as possible, but within 28 days of delivery. In any case, the consumer has met the return deadline if they send the product back before the cooling-off period has expired.
• The consumer returns the product with all supplied accessories, where reasonably possible in its original condition and packaging, and in accordance with the reasonable and clear instructions provided by LiveYourSports.
• The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.
• The consumer bears the direct cost of returning the product. If the trader has not stated that the consumer must bear these costs, or if the trader indicates that it will bear the costs itself, the consumer does not have to pay the return costs.
• If the consumer exercises their right of withdrawal, all additional agreements are cancelled.
Article 9 – Obligations of the trader in the event of withdrawal
• If LiveYourSports allows the consumer to give notice of withdrawal electronically, it will send a confirmation of receipt without delay once the notice has been received.
• LiveYourSports refunds all payments made by the consumer, including any delivery costs charged by LiveYourSports for the returned product, without delay and no later than 14 days after the day on which the consumer gives notice of withdrawal.
• LiveYourSports uses the same payment method for the refund as the consumer used, unless the consumer agrees to another method. The refund is free of charge for the consumer.
• If the consumer chose a more expensive delivery method than the cheapest standard delivery, LiveYourSports does not have to refund the extra cost of the more expensive method.
Article 10 – The price
• During the validity period stated in the offer, the prices of the products offered will not be increased, except for price changes due to changes in VAT rates.
• The prices stated in the product offer include VAT.
Article 11 – Performance of the agreement and additional guarantee
• LiveYourSports guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable requirements of soundness and usability, and the statutory provisions and government regulations in force on the date the agreement was concluded. If agreed, LiveYourSports also guarantees that the product is suitable for other than normal use.
• An additional guarantee provided by LiveYourSports, its supplier, manufacturer or importer never limits the statutory rights and claims the consumer can assert against LiveYourSports under the agreement if LiveYourSports has failed to fulfil its part of the agreement.
• An additional guarantee means any commitment by LiveYourSports, its supplier, importer or manufacturer granting the consumer certain rights or claims that go beyond what it is legally obliged to provide if it has failed to fulfil its part of the agreement.
Article 12 – Delivery and fulfilment
• LiveYourSports will take the greatest possible care when receiving and fulfilling orders for products.
• The place of delivery is the address the consumer has provided to LiveYourSports.
• LiveYourSports will fulfil accepted orders as quickly as possible, but no later than within 3 days, unless a different delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partly fulfilled, the consumer will be notified no later than 7 days after placing the order. In that case, the consumer has the right to cancel the agreement free of charge.
• After cancellation in accordance with the previous paragraph, LiveYourSports will refund the amount paid by the consumer as soon as possible.
• The risk of damage to or loss of products lies with LiveYourSports until the moment of delivery to the consumer or to a representative designated in advance and made known to LiveYourSports, unless expressly agreed otherwise.
Article 13 – Payment
• Unless otherwise stated in the agreement or additional terms, amounts owed by the consumer must be paid within 14 days of the start of the cooling-off period, or, if there is no cooling-off period, within 14 days of concluding the agreement.
• When selling products to consumers, the general terms and conditions may never require the consumer to pay more than 50% in advance. Where advance payment has been agreed, the consumer cannot assert any rights regarding the fulfilment of the order or service(s) concerned until the agreed advance payment has been made.
• The consumer is obliged to report any inaccuracies in payment details provided or stated to the trader without delay.
• If the consumer does not meet their payment obligation(s) on time, and after the trader has pointed out the late payment and given the consumer 14 days to still meet their payment obligations, the consumer owes statutory interest on the outstanding amount if payment is not made within this 14-day period, and the trader is entitled to charge the extrajudicial collection costs it has incurred. These collection costs amount to a maximum of: 15% on outstanding amounts up to € 2.500,=; 10% on the following € 2.500,= and 5% on the next € 5.000,=, with a minimum of € 40,=. The trader may deviate from these amounts and percentages in the consumer's favour.
Article 14 – Complaints procedure
• The trader has a sufficiently publicised complaints procedure and handles complaints in accordance with this procedure.
• Complaints about the performance of the agreement must be submitted to the trader in full and clearly described within a reasonable time after the consumer has discovered the defects.
• Complaints submitted to the trader will be answered within 14 days of the date of receipt. If a complaint is expected to take longer to process, the trader will reply within the 14-day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed answer.
• The consumer must in any case give the trader 4 weeks to resolve the complaint by mutual agreement. After this period, a dispute arises that is eligible for the disputes procedure.
Article 15 – Disputes
• Agreements between the trader and the consumer to which these terms and conditions apply are governed exclusively by Dutch law.
Article 16 – Additional or deviating provisions
Provisions that are additional to or deviate from these terms and conditions may not be to the consumer's detriment and must be recorded in writing or in such a way that the consumer can store them in an accessible manner on a durable medium.
